In Malaysia, istibdal waqf, which means the exchange or substitution of waqf property, is a mechanism allowed for enhancing the utility of waqf assets. However, the legal frameworks and fatwas governing istibdal waqf differ across various states, leading to challenges in its implementation and management. Therefore, this study analyzes the legal structures and fatwas pertaining to istibdal waqf in Malaysia, and examines their effects on the management and sustainability of waqf assets. The problem stems from the inconsistent legal provisions across different states and varying fatwas issued by respective Islamic religious councils. These inconsistencies create barriers to the efficient use of waqf property, ultimately limiting the potential of waqf as a tool for economic development. The study employs a qualitative research methodology, including a review of statutory laws, fatwas, and guidelines from state Islamic authorities. The findings reveal that discrepancies in legal interpretation and fatwas significantly hinder the effective management of waqf assets, leading to delays in decision-making and underutilization of property. To address these issues, the study recommends the standardization of istibdal waqf regulations across states and a more unified fatwa issuance process to streamline the management and revitalization of waqf properties. This research contributes to a better understanding of the governance of waqf in Malaysia and offers practical solutions to improve its administration for greater socio-economic impact.
2025-06-30T00:00:00+08:00Copyright (c) 2025 Nor Amni Bazilah Binti Mohd Zain, Fuadah Binti Johari, Muaz Mohd Ghani Basrihttps://journaljamalullail.kuips.edu.my/index.php/journal/article/view/174Analisis Maqāṣid Syarīʻah Terhadap Penentuan Fatwa Berkaitan Alkohol Dalam Pemakanan Di Malaysia2025-05-07T15:41:55+08:00Nor Musfirah Mohamadmusfirah3019@gmail.comBasri Ibrahimbashim67@unisiraj.edu.myFathullah Asnifathullah@usm.my
Maqāṣid Syarīʻah has been clearly applied in various laws since the time of the Prophet, his companions and his friends including drinking and consumption. Its application is then expanded by today's scholars who summarize food and beverage laws in general, if it provides good and illegal when it comes to harm. Therefore, this study aims to analyze the maqāṣid syarīʻah in determining alcohol -related fatwa in nutrition in Malaysia. It was decided by the National Council Fatwa Committee for Islamic Religious Affairs of Malaysia (JFMKI) and the State Fatwa Committee (JFN). This study uses a qualitative approach that involves document analysis methods as well as interview methods. Data are obtained, analyzed using inductive, deductive and comparative methods. The findings of the study found that the Fatwa Committee in Malaysia took into account the judgment of maqāṣid syarīʻah in deciding the fatwa related to alcohol in food and beverages despite the simple answer or decision of the fatwa without further description as in the Fatwa collections. The analysis of the maqāṣid syarīʻah in the determination of the fatwa of alcohol was grouped into five principles namely Hifz al-Nafs; preserving life and personal safety, Hifz al-'Aql; preserving the intellect, Hifz al-Din; preserving religion, Hifz al-Mal; preserving property and property rights, Hifz al-Muruah; Preserve dignity. The application of maqāṣid syarīʻah can improve the views of the law and fatwa decided by the authority bodies. Therefore, an integrated approach in various aspects needs to be done to enable the right methods of use with Islamic law to meet the needs of individuals and communities now in accordance with the principles of maqāṣid syarīʻah to preserve well -being and avoid harm in the world and the hereafter.
2025-06-30T00:00:00+08:00Copyright (c) 2025 Nor Musfirah Mohamad, Basri Ibrahim, Fathullah Asnihttps://journaljamalullail.kuips.edu.my/index.php/journal/article/view/178Fiqh Islam dan Keselamatan Makanan: Perspektif Semasa Pasca Pandemik COVID-19 2025-06-14T03:17:26+08:00Ahmad Syihan Ismailsyihanismail@unisiraj.edu.myAbdul Salam Zulkifliabdulsalam@unisiraj.edu.myAhmad Hamdani Fakhruddin Mukhtarahmadhamdani@unisiraj.edu.myMohd Hanif Hazaharihanifhazahari@unisiraj.edu.my
The COVID-19 pandemic introduced unprecedented challenges to global food security, affecting food distribution, market stability, and consumer access. This study was conducted to address the growing need to understand how the Qur’an has been preserved across different historical phases without compromising its authenticity. The primary objective of this research is to examine the transformation of Qur’anic compilation from memorization and manual inscription to script standardization, early printing, and modern digitization while highlighting its continued relevance and accessibility in the digital age. This qualitative study employed document analysis through library research, utilizing classical and contemporary sources, scholarly journals, and digital archives. The findings reveal that although the medium has evolved, the integrity and content of the Qur’an remain unchanged. Furthermore, the development of mobile applications, online platforms, and special accessibility tools such as Braille Qur’an and sign language have significantly enhanced inclusive access to the scripture. In conclusion, this transformation illustrates the harmonious balance between tradition and technology in ensuring the preservation and dissemination of the Qur’an for future generations. A connected chain of transmission (ittisāl al-sanad) is a fundamental condition in determining the authenticity of any sanad. Hadith scholars have established that the first criterion for a hadith to be deemed sahih (authentic) is an unbroken chain of reliable narrators. However, there are several instances within the Naqshbandi spiritual lineage that reveal breaks or disconnections in the chain of transmission. Therefore, this study aims to evaluate the sanad of the Naqshbandi order and examine the chain of narrators involved, with specific attention to the direct connections between each narrator, ensuring no disjunctions occur. The study also seeks to understand the implications of such findings on the validity of the sanad based on the principles of hadith sciences (ʿulūm al-ḥadīth). In terms of methodology, this research adopts a detailed textual analysis of the Naqshbandi sanad, particularly focusing on the relationship between each narrator and their immediate predecessor. A critical approach towards hadith sources is employed to assess the strength and integrity of the chain. Research data is gathered through library research and analysed systematically. The findings of this study are hoped to contribute to a clearer understanding of the reliability criteria for a sanad in the context of hadith scholarship, and to provide useful guidance to hadith scholars and researchers. In certain situations, there are instances where conflict arises between public and specific interests, requiring careful consideration to determine which interest should take precedence. Among the issues that require such consideration is the method of al-radd in the distribution of faraid (inheritance) in specific situations, particularly in Malaysia. Therefore, this study aims to explain the considerations considered based on the Sunnah in determining whether public or specific interest should be prioritized when such a conflict occurs. The focus is on the issue of the al-radd method in the distribution of inheritance, based on fiqh principles related to determining which interest should prevail. To achieve this objective, the study employs a qualitative method by collecting data through library research. Data analysis focuses on arguments that can guide the consideration between public and specific interests, particularly in the issue of the al-radd method. The findings of the study indicate that public interest will be prioritized when it conflicts with specific interest, but under certain conditions. However, there are exceptions in specific situations where specific interest is prioritized over public interest. In the case of the al-radd method, if the remaining estate is returned to the heirs, it does not significantly affect public interest. Thus, through the al-radd method, in certain cases, the welfare of the heirs can be preserved without neglecting public interest.
2025-06-30T00:00:00+08:00Copyright (c) 2025 Ahmad Syihan Bin Ismail, Ahmad Sabiq Bin Abdul Rahman, Hanaffie Bin Hasin https://journaljamalullail.kuips.edu.my/index.php/journal/article/view/180Petunjuk Nabawi Dalam Mendepani Fitnah Akhir Zaman: Sebuah Kajian Tematik2025-06-18T15:37:35+08:00Ali Abdul Jalilalijalil@unisiraj.edu.myMohamad Hafiz Darpenhafizdarpen@unisiraj.edu.myMuaz Mohd Ghani Basrimuazghanibasri@unisiraj.edu.myKhalilullah Amin Ahmadamin@usm.my
The tribulations of the end times are events that are certain to occur. One of the works traditionally associated with this field is al-‘Ilal al-Ṣaghīr by al-Tirmidhi, which has often been categorized as a work in ‘ilal al-ḥadīth. However, its structure and methodological approach raise questions about whether it should be more accurately classified as a work of uṣūl al-ḥadīth rather than ‘ilal al-ḥadīth. This study reassesses the classification of al-‘Ilal al-Ṣaghīr through a comparative analysis with Muqaddimah Ṣaḥīḥ Muslim by Muslim ibn al-Ḥajjāj, a recognized cornerstone of uṣūl al-ḥadīth. Using a qualitative methodology, this research employs document analysis and content analysis to examine the structure, themes, and methodologies of both works. The findings indicate that al-‘Ilal al-Ṣaghīr does not focus primarily on ‘ilal al-ḥadīth but rather encompasses broader discussions on muṣṭalaḥ al-ḥadīth, al-jarḥ wa al-ta‘dīl, and general principles of hadith authentication. In contrast, Muqaddimah Ṣaḥīḥ Muslim systematically elaborates on foundational uṣūl al-ḥadīth, with a clear emphasis on the criteria for accepting and rejecting hadith. Neither work delves deeply into ‘ilal al-ḥadīth, as Muslim’s dedicated work, al-Tamyīz, serves that function. The study concludes that al-‘Ilal al-Ṣaghīr aligns more closely with uṣūl al-ḥadīth rather than ‘ilal al-ḥadīth. This reclassification refines the understanding of its academic positioning and contributes to a more accurate classification within hadith studies. The study also suggests further research on the pedagogical implications of teaching al-‘Ilal al-Ṣaghīr, as instructional approaches may influence its perceived classification.
